Terms & Conditions

1

Definitions

The following terms, as used hereinafter, when used with the first letter of the word capitalised, shall have the following meanings:

1. ‘Internet Gambling Licence’ or the ‘Licence’: The administrative licence issued by the Hellenic Gaming Commission to Organise or Conduct Games. Only two types of licences are provided for: a) Type 1 Licence to conduct Online Betting and b) Type 2 Licence to conduct Other Online Games.

2. ‘Suitability Licence or ‘SL’: The act approving the fitness of a person in accordance with the relevant provisions of the Gaming Regulations on the Suitability of Persons.

3. ‘Anti-Money Laundering Authority’: The National Anti-Money Laundering Investigation Authority pursuant to Article 47 of Law 4557/2018 (Government Gazette Series I, No 139), as applicable at any given time.

4. ‘Unusual transaction or activity’: Transactions or activity as per Article 3(15) of Law 4557/2018 (Government Gazette Series I, No 139).

5. ‘Conduct’: The conduct of games pursuant to Article 25(s) of the Law. Where the provisions of this Agreement provide for the concept of Conduct, the concept of Organisation shall be construed as such and vice versa.

6. ‘Organisation’: The conduct of games pursuant to Article 25(r) of the Law. Where the provisions of this Agreement provide for the concept of Organisation, the concept of Conduct shall be construed as such and vice versa.

7. ‘H.G.C.’ or ‘HGC’ or the ‘Authority’: The Hellenic Gaming Commission

8. ‘Electronic Player Account (EPA)’ or ‘Your Electronic Account’: The account as per Article 25(o) of the Law.

9. ‘Website’: The website through which the Licence Holder conducts Games of Chance; it belongs to the Licence Holder and must have a domain name ending in .gr.

10. ‘Regulation’ or ‘Gaming Regulation’: The Gaming Regulation as per Article 29 of the Law on the ‘Organisation and Conduct of Online Games of Chance’.

11. ‘Anti-Money Laundering Regulation’:The decision of the HGC issued by authorisation of Article 28(3)(f) of Law 4002/2011.

12. ‘Suitability’: The determination by the HGC or the Licence Holder that the person(s) satisfy the qualifications and conditions for the issuance of an SL and/or Suitability Statement in accordance with the relevant provisions of the Gaming Regulation on the Suitability of Persons.

13. ‘Manufacturer’: The person who manufactures (indicatively, conducts studies, designs, assembles, produces, or programs Technical Tools and Materials), and in any way supplies Technical Tools and Materials to Licence Holders and is registered in the relevant white list register kept by the HGC.

14. 'Licence Holder’ or ‘Holder’: The legal entity that provides Gambling Organisation and Conduct services and which has been granted a Licence to conduct Online Games of Chance, in accordance with the provisions of the Law and the Regulation. Each Holder may be granted both types of Licence. For the purposes of this Agreement, ‘Licence Holder’ refers to Novibet.

15. ‘Jackpot System’: Any fixed or progressively increasing value or combination thereof awarded to Players, which is regulated by the Game Manufacturer or Licence Holder, at the Game level, or at the Game interface level, or at the system level, or any combination of the above.

16. ‘Other Online Games’: In accordance with Article 25(x) of the Law, these are casino games, and poker and its variants, offered online and conducted either live, or with the use of a random number generator.

17. ‘Instrument of Payment’ means any Money Transfer, debit card, credit card, prepaid card, e-wallet, personalised device, cash and any other means used by the Player to deposit and disburse amounts, during the conduct of Games, in accordance with applicable provisions. 

18. ‘Money Transfer’: Any transaction made by electronic means, by a Payment Service Provider on behalf of a payer. The purpose is to make money available to a beneficiary via a Payment Service Provider, regardless of whether the payer’s Payment Service Provider and that of the payee are the same entity, including: a) credit transfer b) direct debit c) remittance services in accordance with the provisions of 4537/2018 (Government Gazette Series I, No 84), as well as d) transfer made using a payment card, for any type of electronic money or any other personalised device with similar characteristics and functionality, in accordance with existing provisions.

19. ‘Non-cooperating States’: The countries and jurisdictions as per Article 65(3) of Law 4172/2013 (Government Gazette Series I, No 167) as well as the countries of Annex II(3) of Law 4557/2018 (Government Gazette Series I, No 139).

20. ‘The Law’: (Greek) Law 4002/2011 (Government Gazette Series I No 180), as in force at any given time.

21. ‘Game Guide’ or ‘Guide’: The information material posted on the Website by the Licensee in the Greek language which includes, per Game or Group of Games, all necessary information regarding Participation for Players, the terms and conditions of the Games, as well as the table of returns/distribution of winnings, as appropriate.

22. ‘Certification Body’: The certification body operating a qualified Test Lab recognised by the HGC in accordance with the Gaming Regulation on Suitability of Persons, or a certification body accredited in accordance with current European and/or international standards, by the Hellenic Accreditation System SA (ESYD), a non-profit legal entity under private law, or by accreditation bodies of other countries with which the National Accreditation System SA has signed a mutual recognition agreement.

23. ‘Terms and Conditions’: All terms of this Accession Agreement are considered material.

24. ‘Player’ or ‘You’ or any other reference to a second person, whether the first letter is capitalised or not: You, as a natural person, constituting the Novibet counterparty.

25. ‘Gaming Activity’: The set of data related to Your Participation in Gambling.

26. ‘Certification’: Approval for installation and commissioning into operation of the Technical Tools and Devices subsequent to certification by a Certification Organisation with regard to compliance with the Technical Specifications, or supporting documentation for Technical Tools and Devices with the technical and functional characteristics equivalent to these specifications.

27. ‘Personal Data Protection Policy’: The Licence Holder's company policy in relation to the personal data and information it collects, in particular as to the manner in which the data and information are collected, the purpose and legal basis of their processing, the manner of use, notification of other parties, storage and data and information protection, data subjects' rights, and technical and organisational security measures.

28. ‘Actual Beneficiary’: The natural person on whose behalf the transaction or activity is carried out, in accordance with the provisions of Article 3(17) of Law 4557/2018 (Government Gazette Series I, No 139).

29. ‘Regulatory Framework’: The Gaming Regulation and all other legislative and other regulatory provisions, as well as licence terms and conditions, which determine the conditions of the legal Organisation and Conduct of Gambling in the Greek Territory, as well as HGC Directives.

30. ‘Accession Agreement’ or ‘Agreement’: This agreement between you and Novibet that permits you to legally participate in games of chance conducted online by Novibet.

31. ‘Participation’: The registration of the Player's information/preferences in each Game of Chance and the validation thereof after payment of a fee.

32. ‘Affiliate’: A person who cooperates with the Licence Holder for the promotion of specific Games, through the posting of links on their website, in order to attract more players to the Website of the advertised online gambling Licence Holder, who are subject to the provisions of Article 35 of the Law, have received for this purpose a Suitability Licence from the HGC and are listed in the respective Register.

33. ‘Technical Tools and Devices for Gaming’ or ‘TTD’: Certified equipment as required, i.e. instruments/equipment/electronic devices/mechanical or electromechanical and electronic programs (any kind of software or computer system), used directly or indirectly for the Organisation and Conduct of Games and which is related and/or influences and/or determines and/or monitors and records the outcome of the Games or the conduct of the Games in general.

34. ‘Gambling’, ‘Games of Chance’ or ‘Games’: Online Betting as per Article 25(c) of the Law and Other Online Games as per Article 25(x) of the Law, which may be legally organised and conducted in the Greek territory by the Licence Holder, via the Website, and for which the requisite certifications have been obtained.

35. ‘Responsible Gaming’ or ‘Responsible Gambling’: The set of principles and obligations of the Licence Holder and the arrangements of the HGC Gaming Regulation and Guide, which have the aim of ensuring that any activity in the gambling sector is carried out in accordance with applicable legislative provisions, in a socially responsible manner, in order to minimise negative consequences for Players arising from their participation in Games of Chance.

36. ‘Suspicious transaction or activity’:  Transactions or activity for which there is circumstantial evidence or suspicions of attempts to commit or commission of the offences as per Article 2 of Law 4557/2018 (Government Gazette Series I No 139) or the involvement of the Player or the Actual Beneficiary in criminal activities, based on an evaluation of the details of Player Activity and the Player, including the nature of Gaming Activity, the category of financial instrument, the frequency, complexity and value of transactions, the use of cash or otherwise, and the person’s occupation, financial standing, transactional conduct, reputation, history, and other aspects of significance to characterisation of the transaction information.

37. ‘Novibet’: The company established in Malta (at 170 Peter House, Level 1 Suite 271, Psaila Street, Birkirkara BKR 9077) trading under the name ‘Gamart Limited’, registered in the Malta Business Registry (MBR) under number C95282.

Purpose And Object Of The Agreement

2.1 This agreement is entered into between you and Novibet in order for you to legally participate in games of chance conducted online by Novibet. The object of the Agreement is the declaration of the rights and obligations of the contracting parties (namely Novibet and you), in accordance with the Regulatory Framework.σιο.

2.2 You understand and agree to enter into this Agreement with Novibet, namely, the company established in Malta (with registered offices at 170, Peter House, Level 1 Suite 271, Psaila Street, Birkirkara BKR 9077) trading under the name ‘Gamart Limited’, with distinctive title ‘Gamart Limited’, registered in the Malta Business Registry (MBR) under number C95282, with contact email address [email protected].gr and gaming website, for the Greek territory, as follows: www.novibet.gr. Novibet is the holder of the following Licences: (a) EEEP-HGC-000022-LH Type 1 Licence to Conduct Online Betting and (b) EEEP-HGC-000023-LH for Type 2 Licence to Conduct Other Online Games. Licence (a) above permits Novibet to conduct online betting games and is valid from 15 June 2021 until 15 June 2028. Licence (b) above permits Novibet to conduct Other Online Games, as determined by the Law (i.e. casino, poker gambling games and variations thereof), which are provided online and conducted either live or using a random number generator, and is valid from 15 June 2021 until 15 June 2028. These two (2) Licences were granted by the HGC in accordance with the Law and Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II 3265). This Agreement has been approved by the HGC under the latter’s Decision No 9194 dated 27.07.2021.

2.3 The purpose of this Agreement is to regulate your Participation in the Games in accordance with the applicable legal and regulatory framework governing the organisation and conduct of the Games. By accepting this Agreement, you unconditionally agree to abide by its Terms, the Personal Data Protection Policy and other Novibet Gaming Participation policies.

Conclusion And Amendment Of The Agreement

3.1 This Agreement has been approved by the HGC. Any amendment thereto must be approved by the HGC, and shall not otherwise be posted on Novibet’s websites.

3.2 This Agreement and any amendment thereto are concluded on acceptance of its Terms and Conditions by You. Acceptance of this Agreement as well as any amendment thereto is made electronically, in an express manner not open to doubt.

3.3 In the event of any amendment to this Agreement, Novibet shall notify you thereof the first time you log in to your Online Account following the posting of the amended Agreement, making specific reference to the amendments that have been made.

3.4 Acceptance of the amended Agreement is carried out through acceptance of its Terms and Conditions by You when you connect to your Electronic Account for the first time after the amended Agreement has been posted.

3.5 If you do not accept the amended Agreement, it shall be duly terminated and the terms of termination with regard to closure and settlement of transactions shall apply, in compliance with the provisions of Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265), the Anti-Money Laundering Regulation, and other applicable legislative provisions.

4

Games Offered

4.1 The games conducted by Novibet under the valid Hellenic Gaming Commission Type 1 Online Betting Licence Ref. EEEP-HGC-000022-LH are the following: sporting events and virtual events (virtuals).

4.2 The games conducted by Novibet under the valid Hellenic Gaming Commission Type 2 Licence Ref. EEEP-HGC-000023-LH for the conduct of Other Online Games are as follows: casino games conducted live in a special location (studio), with a live dealer, the outcome of which is not determined by a random number generator (RNG); and casino games, the outcome of which is determined by a random number generator (RNG).

4.3 With regard to the conduct of certain games, Novibet cooperates with manufacturers who are registered in the relevant register kept by the Hellenic Gaming Commission. The details of the respective manufacturers can be found at the following link  (certifications.gamingcommission.gov.gr/publicRecordsOnline/SitePages/KataskevastesOnline.aspx).

4.4 You understand that the specific rules for conducting each individual Game or category/group of Games conducted by Novibet are included in the Gaming Guide which you can read at the following link  (www.novibet.gr/info/rules). Information contained in the Game Guide includes descriptions of the environment for organising and conducting betting events, the rules of the sports, the rules of the Games, the categories of winnings, the odds of winning, the manner in which the winning outcome is obtained, minimum and maximum participation amounts, (where applicable) the odds multipliers, the manner in which betting odds are calculated, the commission (rake) that may be withheld by Novibet for Participation, the manner in which tax on winnings is calculated for an individual game or Group of Games, the terms under which jackpots operate, screen displays, etc.

4.5 You understand that your Participation in the Games implies the unconditional acceptance of the currently valid Game Guide as above, which you can read at the link (www.novibet.gr/info/rules), where you can search for more information by individual Game or category/group of Games.

Participation In The Games

5.1 Creating an Online Player Account

In order to be eligible to participate in the online Games of Chance provided by Novibet, you must be a natural person, have accepted the Terms and Conditions of this Agreement and Novibet must create an Online Player Account for You. A unique Electronic Account is maintained by Novibet for each player and You participate in Novibet Games exclusively with this Account. The creation of multiple Electronic Accounts for the same Player or the management of a Player’s Electronic Account by third parties is prohibited.

To create an Online Player Account, you must complete the relevant registration form available on the Novibet Website. Before completing the registration form, we recommend that you read the Terms & Conditions of this Agreement carefully, so that you are aware, among other things, of the following:

a. The information that you need to provide in order to create an Online Player Account, in accordance with the Anti-Money Laundering Regulation and Novibet's corporate policy, including the place, time and method of submission. The information in question can be found at the following link: (https://www.novibet.gr/info/kyc).

b. The fact that Novibet is required to consult the register of excluded persons, kept by Novibet itself and by the HGC, in order to establish that the person requesting the creation of an Electronic Account is not listed therein, and that the request for the creation of an Electronic Account shall be rejected if the person is listed in the register of excluded persons. 

c. The guarantee declarations that you are required to make in order to create an Electronic Player Account, in particular that:

aa. You have full legal capacity and there is no other impediment affecting your participation in the Games.

bb. You are over 21 years of age

cc. Your Participation in the Games is your free and independent personal choice and takes place without provocation or inducement.

dd. You have the obligation to use your Electronic Account exclusively on your own behalf and not on behalf of a third party.

ee. You have the obligation to notify Novibet, without undue delay, in the event of a change in any personal information provided at the time of your registration and/or thereafter.

ff. You have the required software and hardware to use the services and receive updates and notifications from Novibet.

d. That once you enter into this Agreement, you are aware, fully understand and accept that you will NOT be permitted:

aa. To create and/or use more than one Online Player Account.

bb. To use a third party’s means of financial transaction, such as indicatively: bank account and/or debit and/or prepaid card, etc.

cc. To use the services provided by Novibet outside Greek territory.

dd. To attempt to participate while having temporary abstention or exclusion status.

ee. To attempt to or to Participate in cartels (‘fixing games’, ‘collusion’ etc.) or to follow unfair practices.

e. That once you enter into this Agreement, you are aware, fully understand and accept that:

aa. You are required to use a unique Username in combination with a secret Password in order to log in to your Electronic Account and make use of it. The combination of these two elements is unique to you, is used for your identification, constitutes evidence of use of the services provided by Novibet, and confirmation of acceptance of the Terms and Conditions of this Agreement. Without prejudice to any additional identification or security measures taken when making online monetary transactions by payment service providers or Novibet software, it demonstrates your willingness to trade on your own behalf and confirms that your Participation in the Games is of your own volition alone, without inducement or provocation from third parties.  

bb. You must keep the information you use to log in to your Online Account secure, use it in secret and change it periodically, notifying Novibet without undue delay as soon as you become aware of any loss or misuse.

cc. You are required to change your Online Account login information whenever required by Novibet in accordance with its security policy.

dd. The process of verifying your identity shall be repeated by Novibet whenever there are doubts as to the validity, accuracy and/or completeness of the information supplied.

ee. Novibet consistently and systematically implements due diligence measures in accordance with the provisions of Law 4557/2018 (as applicable at any given time), the Anti-Money Laundering Regulation and its corporate policy, and may take any appropriate action, including blocking of your Electronic Account, refusal to provide services or payments or the issuance of a certificate of winnings, if the conditions of certification and verification of your identity are not met, or if based on the data, risk analysis, policy or tools it uses, determines or has serious indications or grounds to believe that Suspicious or Unusual Transactions have been or are being carried out, or have been or are being attempted.

ff. Novibet may refuse to provide services or payments or to provide a certificate of winnings paid if it is established that you are a national of a country designated by the European Commission as at high risk for money laundering and terrorist financing, or belonging to Non-Cooperative States, or if you are included in corresponding lists of the Authority, the competent police, administrative or judicial authorities, where such lists exist and are accessible to Obliged Persons, or included in the respective HGC Registers pertaining to restrictions, or following a court order or an order from the National Authority for Combating Money Laundering.

gg. Novibet uses special systems and tools to verify the details of the Players, including the identification of the technical means and devices used for Participation, as well as any other appropriate means, including the gathering and evaluation of Gaming Activity patterns.

hh. Novibet may apply strong player identification systems and procedures including two-factor authentication, strong customer authentication (2FA, SCA), equivalent in strength and effectiveness to those foreseen by the provisions of Directive (EU) 2015/2366, and using two or more details of knowledge (known only to the user) or possession (something only the user possesses) as well as a unique physical characteristic (inherent to the user), elements that are independent, such that the breach of one does not jeopardise the credibility of the others.

ii. Novibet provides You, through your Electronic Account, with full access to information regarding your Account Balance, Gaming History, including Participations, winnings and losses, deposits and withdrawals, as well as other transactions made during Participation.

jj. The files and data pertaining to your data, your Gaming Activity and the transactions that you carry out through Your Account, are kept by Novibet for ten (10) years, and remain at the disposal of the HGC as well as any other authority acting within the scope of its responsibilities, in compliance with legislative provisions pertaining to Personal Data Protection, and in accordance with the relevant terms of this Agreement and Novibet’s Privacy Policy.

kk. Transactions that exceed the respective monetary limits set by the Anti-Money Laundering Regulation are executed only if it is confirmed, prior to the transaction, that the payment account you have declared actually belongs to You.

ll. Novibet takes appropriate steps to manage and reduce operational and security risks associated with the services it provides and, in this context, implements effective incident management procedures, including the identification and classification of major incidents affecting operations and security.

mm. Novibet bears no responsibility for any loss that may be caused due to your act or omission, leading to improper or incorrect use of your Electronic Account.

nn. The data and information provided to the Players through the Player's Electronic Account and the Website, such as, indicatively, Participations, sporting events, match schedules, odds, results, account balance, gaming behaviour information, etc., are provided for the exclusive use of Players, and the distribution or commercial exploitation of such information is strictly prohibited.

oo. The information and data provided by Novibet do not constitute advice or recommendations intended to encourage or induce any person to Participate in the Games being conducted.

pp. You are prohibited from using the services for any purpose other than Participation.

qq. In order to make your visit to the website user-friendly, Novibet monitors site traffic with cookies, which it receives from your browser or Novibet’ client software. In any case, you have the right to refuse installation and/or continuous transmission of information contained in cookies, apart from those that, in the reasonable judgment of Novibet, are required for the legal, proper and convenient provision and use of its services. 

5.2 Online Player Account Status

This section of the Agreement contains the Terms and Conditions that describe the types of status that may apply to your Online Account, the reasons why your Electronic Account may be assigned this status, and the consequences that a specific status may have for Account operation. The following Online Player Account status types can be distinguished:

5.2.1 Provisional Online Account

You are aware of the following:

a. On creation, your Electronic Account is assigned ‘Provisional’ status until the requisite information is submitted and verified, in accordance with the provisions of the Anti-Money Laundering Regulation, through the following must be verified:

aa. That the details of the person for whom the Electronic Account was created correspond to a real person.

bb. That the person for whom the Electronic Account was created is the same as the person requesting its registration.

cc. That the person for whom the Electronic Account was created is in fact the person whose details have been submitted, based on requirement aa) above.

b. For as long as the Electronic Account has "Provisional" status, You:

aa. May not deposit amounts that cumulatively exceed the current limit in the specific case as per the Anti-Money Laundering Regulation.

bb. May not withdraw amounts, pursuant to the provisions of the Anti-Money Laundering Regulation.

c. If your Electronic Account is not finalised within the deadline stipulated in the Anti-Money Laundering Regulation, Novibet will assign ‘Blocked’ status to your Electronic Account and it will stop accepting transactions from you, setting a deadline of thirty (30) days from the date on which the Account was blocked in order for you to take the necessary steps and provide the necessary information for certification and verification of your identity. Once you provide the requested information, Novibet will activate your Electronic Account. If the above deadline expires or the information provided by you is still insufficient, Novibet will close your Electronic Account, clearing its transactions with you in accordance with the Anti-Money Laundering Regulation. 

5.2.2 Inactive Online Account

You understand that, in accordance with Minister of Finance Decision No 79835 EX 2020/24.7.2020(Government Gazette Series II, No 3265), in the event of your continued failure to Participate for a period of twelve (12) months, your Electronic Account will be assigned ‘Inactive’ status. At least thirty (30) days before the upcoming assignment of ‘Inactive’ status, you will be notified that your Account is about to enter Inactive status, and you will also be notified of the following:

a. That for the duration of the period during which your Account has been assigned ‘Inactive’ status:

aa. Your Participation in the Games is prohibited.

bb. Novibet may impose maintenance fees on the Account, amounting to five (5) Euros per month.  

b. That if a period of twelve (12) months elapses from the date on which your Account was assigned inactive status, during which your Account was not reactivated or, although activated, there was no participation in the Games, Novibet will close your Account and terminate its contractual relationship with You.

c. That if you participate at least once during the period before the twelve (12) month period has elapsed, the ‘inactive’ status of your Account will be lifted.

d. That after your Account has been assigned ‘inactive’ status, you have the following options:

aa. To request the closure of your Account and the termination of your contractual relationship with Novibet by withdrawing any credit balance from your Account after any maintenance fees have been withheld.

bb. To request the reactivation of your Account and the restoration of rights to engage in participations. You are aware that, in this case, Novibet is obliged (based on the information it keeps, its analysis of risk, the policy it applies and the tools at its disposal) to proceed with an assessment of whether the restoration of your Account to its former status should also require repetition of the identity verification process, in accordance with the provisions of the Anti-Money Laundering Regulation.

5.2.3 Blocking an Online Account

You are aware that Novibet will assign ‘Blocked’ status to Your Account in the following situations:

a. In the event of your temporary abstention or your temporary exclusion from the Games.

b. Subsequent to a court order.

c. At the discretion of the HGC, if, from the evidence available to the Authority, it is necessary to block your Account for reasons of associated with ensuring the integrity of the Games and the maintenance of public order.

d. In the event of a duly justified decision by Novibet, if, based on the data, risk analysis, policy or tools it uses, it determines or has serious indications or grounds to believe that Suspicious or Unusual Transactions have been or are being carried out, or have been or are being attempted, or that breach of the integrity of the Games is threatened. In this case Novibet is obliged to proceed with the necessary actions in accordance with Law 4557/2018 (Government Gazette Series I No 139) and the Anti-Money Laundering Regulation. 

e. In all cases, the assignment of ‘Βlocked’ status to an Electronic Account is an extremely restrictive measure and shall be imposed by Novibet sparingly and for reasons that adequately justify the necessity of resorting to such a measure, and not in an expedient or improper manner.

In addition, Novibet informs you that: 

a. Participation in the Games and the depositing of amounts in your Electronic Account while it is blocked is prohibited.

b. It does not impose fees on Electronic Accounts that have been assigned blocked status. 

c. The block will be lifted when the reasons for its imposition no longer apply

d. If the block has not been lifted within twenty four (24) months from the date on which it was applied, Novibet will close your Electronic Account and terminate the contractual relationship with you.

e. In the event that there are Participations that have not yet been settled when an Account is assigned blocked status, then their settlement shall take place as follows: by cancellation of the participation and return of the bet value to the Player.

f. In the event that you submit a withdrawal request while your Account is blocked, then the request will be handled as follows: Your request will be accepted, unless the withdrawal is contrary to the Regulatory Framework or to the more specific terms of this Agreement or to the Anti-Money Laundering Regulation, or to the specific instructions of the HGC and/or the legally competent bodies and authorities.

Novibet takes decisions to block Accounts, based on objective, valid data and methodology and with sufficient justification. In any event, it will assign blocked status to your Account when it has received an order to freeze your Account or special instructions to do so from the HGC and/or the legally competent bodies and authorities. 

Particular attention shall be paid by Novibet in cases where your Account is blocked, due assumption of use, not by you but by third parties (account takeover), based on device or IP address detection tools, gaming activity pattern identification and evaluation tools, submission of questions to the Player to establish own personal use of their Electronic Account, etc. or a combination of the above. 

Participations using different access devices from different IP addresses does not of itself prove that the Account has been used by a third party, but it may be a clear indication especially when it appears that different devices have been used at the same time or a within a brief period of time from different geographical areas. To this end, Novibet can determine whether or not the Account is being used by you by applying additional means to verify Player identity (e.g. two-factor authentication, strong customer authentication - 2FA, SCA, etc.). In addition, Novibet may require you to register the devices you use to participate in the Games, and to notify you that it will not accept transactions through devices that have not been registered.

Similarly, differences in patterns of Gaming Activity is not sufficient proof or sufficient indication that your Electronic Account is being used by a third party. Novibet is obliged to evaluate the extent of differentiation of a pattern, in combination with the partial data and particularities of each case, in order to validly claim that your Account has been used or is being used by a third party. For example, the mere fact that a Player has decided to significantly increase the amount of their Participation does not, however, mean that this increase can be characterised as unusual in common experience, or that the choice of a different type of Bet (e.g. an accumulator bet (parlay) instead of a single bet or vice versa), and/or organisation, and/or sport and/or game, etc., are not sufficient to justify blocking an Account without there being other evidence duly substantiated by Novibet with the required accuracy, adequacy, completeness and justification, which supports its claim that your Account was or is being used by a third party.

5.2.4 Closed Electronic Account 

Novibet will close your Account and assign ‘Closed’ status to it, in accordance with Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265) in the following cases:

a. Immediately on submission of your application to close your Account.

b. Thirty (30) days after expiry of the deadline for the completion of the identity verification and authentication process, if the information you have provided has not been confirmed, in accordance with the provisions of the Anti-Money Laundering Regulation.

c. Immediately upon submission of your application for indefinite exclusion from the Games.

d. If it determines or has valid, reasoned and strong indications that part or all of the information provided by you for the creation of your Electronic Account is untrue or inaccurate.

e. If twelve (12) months has elapsed from the date on which Your Account was assigned inactive status.

f. If twenty-four (24) months has elapsed since the date on which Your Account was blocked.

Novibet will not close your Account, citing vague or ambiguous reasons, but shall make the respective decision based on data that objectively substantiates its decision to close your Account.

You are aware of the following:

a. You may not set up a new Electronic Account until twelve (12) months have elapsed since Your Electronic Account was closed, and that item b) above is excluded from this prohibition, given that the conditions indicated in item d) above do not also exist.

b. The closure of your Electronic Account terminates the contractual relationship between Novibet and you, and all details of your transactions and Participations that have been made using your Account, as well as any other information or data is kept by Novibet, in connection with and in execution of the obligations of the parties in the context of the contractual relationship, and held by it in the form, manner and for the period of time provided for in Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265) and the existing legislative provisions.  

c. If there is a credit balance in your closing Electronic Account, in accordance with the provisions of Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265) Novibet will pay said balance to the account you have declared as soon as possible and in any case within three (3) working days after the closure of your Electronic Account, in compliance with the provisions of the Anti-Money Laundering Regulation.

d. In the event that, when your Electronic Account is closed, it has been assigned ‘provisional’ status, no winnings shall be paid to you and Novibet shall settle the credit balance of your Account, in accordance with the provisions of the Anti-Money Laundering Regulation.

e. In the event that at the time of closing your Electronic Account, Novibet is aware of or has serious indications or suspicions that the amounts in your Account, regardless of their value, constitute or relate to products of criminal activity or are linked to terrorist financing, it shall apply the relevant provisions of Law 4557/2018 (Government Gazette Series I No 139) and the Anti-Money Laundering Regulation.

5.3 Limits and restrictions of Gaming Activity

This section of this Agreement describes the limits placed on Gaming Activity. These Limits are set either in the context of the compliance with the provisions of Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265) and the HGC Directives, or by virtue of special provisions set out in the more specific Terms and Conditions of this Agreement. The following types of Limits can be distinguished:

5.3.1 Limits set by the Player (You):

The limits set by You, in accordance with the provisions of Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265) and this Agreement, are the following:

a. on the maximum amount deposited (deposit limit)

b. on the maximum amount of potential losses (loss limit), and

c. time limits, in relation to the maximum time for participation in Other Online Games and Bets on virtual events the results of which are obtained through use of a random number generator.

Please be aware of the following with regard to the function and purpose of setting the above limits:

a. That you are obliged to set the above limits, in accordance with Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette, Series II, No 3265) and the principles of responsible gambling.

b. That you should set limits, guided by the principles of prudent gambling behaviour which are commensurate with what is personally affordable, in full awareness of the dangers that your involvement with the games entails.

c. That you can change the above limits after the period for which they were set expires, unless you wish to change existing limits to stricter ones, in which case they can be applied immediately.

d. That you will be notified with an information message from Novibet as soon as you exceed 80% of the limit in question, in accordance with the provisions of Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette, Series II, No 3265).

e. That, in the case of termination of your participation because you have reached your time limit, you will not be permitted to participate in the games for the period remaining until the expiry date of the limit.

f. That, in the event that your pending participation means that you may exceed the loss limit, you are permitted to continue to participate, provided that the bet you intend to make does not exceed loss limit which has been set.

g. That the above participation time limit is set at day level, from midnight 00:00:00 to 23:59:59 of the same calendar day, or week, from Sunday to Saturday, or month, from the first to the last day of the month.

h. That your participation time is calculated on the basis of active participation in Other Online Games, including virtual events, the results of which are obtained using a random number generator.  Your time spent on the website and/or time connected to Novibet’s client software without active participation in the Games (e.g. placing bets etc.) does not count towards the time limit that has been set.

By virtue of your registration and acceptance of this agreement, and before you participate in the Games, you are obliged to set a specific value of your choice for each limit. The "No limit" option may not be available. Novibet ensures that you are able to enter the desired value for each limit. If default values are used, the scale of these values is structured in such a way that, on the one hand, as many options as possible are available to you, and on the other, it ensures that the limit setting system is user-friendly and functional. If you wish to set a value that is not included in the options, Novibet will show you the nearest value available. If rounding of values is required, it is performed to the nearest whole number, in accordance with the condition i≤0.4, i≥0.5, where (i) = the digits of units, tens, hundreds or thousands for which rounding is required.

With regard to making changes to limits, this can be done after the period for which the specific limit was set has expired, unless the change is to a stricter one, in which case it can be applied instantly. Thus, it becomes apparent that, for example, if you set a limit on a monthly basis and then change that limit, the change will take effect on the 1st day of the month following the one in which you make the change to that limit, unless the change was to a stricter limit, whereupon it is applied instantly. Similarly, if you set a limit on a daily or weekly basis and then change this limit, the respective change will take effect on the day after the day on which you changed the limit in question or on the first day of the week following the week in which you changed the limit in question, unless the change is to a stricter limit, in which case it applies instantly.

5.3.2 Limits determined by Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265)

The limits determined by Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265) are the following:

a. A limit of twenty-four (24) hours on the maximum duration of a Gaming Session.

You should be aware that this time limit operates, is calculated and applied independently of the Participation time limit, and that these two limits should not be confused with each other. For the purpose of calculating the twenty-four (24) hour maximum duration of the Gaming Session, time is counted from the moment you access the Novibet Website or connect to the client software using the login information, and the time is calculated regardless of whether you participate in the Games or just browse the Website or stay connected to the client software.

b. A limit of two (2) euros maximum sum for Participation in the Other Online Games the result of which is obtained using a random number generator (RNG).

You should be aware that this limit is applied per Game Cycle and its calculation is based on the minimum unit of participation (‘denomination’).

c. A limit of seventy thousand (70,000) euros maximum payout in Other Online Games, the result of which is obtained using a random number generator (RNG).

You understand that this limit is applied per Game Cycle and for the purposes of calculation the sum all additional permitted Game rewards provided (e.g. Bonus rounds) are added together, with the exception of any Jackpot System prize.

d. A limit of five hundred thousand (500,000) euros as the maximum prize that can be won in a Jackpot System.

You understand that this limit does not apply to prizes in Poker Games and/or variations thereof held in the form of poker tournaments.

e. A limit on the maximum payout per Bet, which may not exceed five hundred thousand (500,000) euros.

5.3.3 Limits and restrictions set by Novibet.

Novibet may set individual Limits for the Participation amount and the maximum payout per Bet, or other Games up to an amount provided for in each case by Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265). The types or categories of such limits are specified in the Gaming Guide (which can be found here (www.novibet.gr/info/rules)), and may concern one or more of the following:

a. Participation Limit.

Novibet implements a procedure for acceptance of amounts exceeding the Participation amount limits, at your request and subject to a written agreement, providing that the agreement does not violate the general and specific limits set by the Regulation. Reaching such an agreement between Novibet and any Player (You) is prohibited in the case of Participations in Other Online Games conducted peer-to-peer. Please contact our Customer Service Department if you wish to arrange such an agreement.

b. Maximum payout per Bet. 

We wish to inform you that the Gaming Guide sets out the individual limits for maximum payouts per Betting event, sport and/or competition, up to the sum of five hundred thousand (500,000) euros, which is the maximum limit set by Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265). The maximum payout per Bet applies to all Players. You understand that in the case of Multiple Entry Betting events for which there are different individual limits, at the level of the sporting event and/or competition, the aforementioned limit is equal to the sum of the maximum individual limits set by Novibet at the level of the sporting event and/or competition. Novibet applies a special procedure for accepting your request for an increase in the maximum payout amount limit for a specific Betting event, provided that this Limit inclusive of the increase does not exceed five hundred thousand (500,000) euros or the sum of the maximum individual limits that have set by the Licensee at the level of the sporting event and/ or competition, in the case that there are different limits for each of these. Please contact our Customer Service Department if you wish to have such an application approved.

c. You understand that Novibet has the right to unilaterally limit your Gaming Activity (Participations, payouts) and/or your transactions (withdrawals), if it deems that there is a danger of illegal transactions taking place, based on factors such as the level of financial risk, the type of Game, the frequency of your Participations, the frequency and amounts of withdrawals from your Account, the amount of expected return, your personal characteristics and qualities (such as occupation, financial standing, gambling behavior, reputation, history, data and information on the basis of which your influence or that of your relatives or persons closely related to you may have shaped the outcome of already offered purchases, your relationship with other Licensees), a strong likelihood of collusion among Players, information and data creating reasonable doubt as to the integrity of a bet etc

d. You understand that Novibet reserves the right to restrict Gaming Activity (Participations, payouts) and/or transactions (withdrawals) in the implementation of its reward/loyalty programs, in accordance with the rules of these programs, and on condition that the Player participating in these programs has received full knowledge of the rules and has consented in advance to their application.

e. You understand that Novibet has the right (as well as the obligation) to limit your Gaming Activity (Participations, payouts) and/or your transactions (deposits/withdrawals), in the context of Responsible Gaming Principles, if from the information in its possession it appears that you are demonstrating problematic gaming behavior.

5.4 Rewards - Loyalty Programs

You are aware of the following:

a. Novibet may reward the Players by implementing reward/loyalty programs, the terms and conditions of which are formulated and promoted in compliance with the provisions of Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265).

b. The terms and conditions of each program apply in the same way to all Players who meet the conditions foreseen in each case for inclusion in the program or any individual parts thereof.

c. Novibet may at any time terminate or modify any program for any reason it deems appropriate, at its sole discretion.

d. Novibet may change or revoke the reward already paid out if it is proven that you received this reward mistakenly or fraudulently knowing that you do not meet the qualifications or that the reward is likely to have been paid out on the basis of transactions and/or practices carried out in violation of the law, proper and ethical transactions, Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265) and the Anti-Money Laundering Regulation.

e. Reward/loyalty programs are subject to our General Terms and Conditions (www.novibet.gr/info/general-promotions-terms)

5.5 Jackpot System  

You are aware of the following:

a. A Jackpot System is any fixed or progressively increasing value or combination thereof awarded to Players, which is regulated by the Game Manufacturer or Novibet, at the Game level, or at the Game interface level, or at the system level, or any combination of the above.

b. Jackpot Systems may not be organised by two or more Licensees acting together.

c. The maximum reward limit that can be paid out by any Jackpot System may not exceed the amount of five hundred thousand (500,000) euros, and the transfer of any sum exceeding the above amount accumulated on the basis of Player Participation to another Jackpot System is obligatory.

d. In any case of reduction in the amount accumulated on the basis of Player Participation or termination of the Jackpot System, an amount equivalent to said reduction or amount accumulated on the basis of Player Participation at the time of termination, must be transferred to another Jackpot System, within three (3) months from the date of the reduction or termination.

e. A winning Player will receive continuous information regarding the payout of prizes in a Progressive Jackpot System until the Game in progress has ended.

f. Information regarding the payouts of a Progressive Jackpot System will be provided to all Players participating in the System at the time when winnings accrue in a manner readily understandable to you, regardless of the means you use to access your Electronic Account.

g. Information on the amounts paid out by a Progressive Jackpot System, as formulated after prizes are awarded, will be provided to all Players participating in the Jackpot System at that time, regardless of the means used by each Player to access their Electronic Account.

h. In cases where a Progressive Jackpot System has to be terminated (e.g. malfunction, loss of connectivity, unexpected termination), Players will be given clear indication that the Progressive Jackpot System will not be functioning due to impending termination and the Jackpot prize cannot be paid out.

i. Reactivating a Progressive Jackpot System from its inactive status will be implemented using exactly the same parameters as were in use before the interruption.

j. If the Progressive Jackpot System operates in conjunction with another Game (i.e. a base game) and the Return to Player requirement is met only when Progressive Jackpot contributions are included, the other Game will only be available when the Progressive Jackpot is available.

k. The Gaming Guide, which you can see here, gives you relevant information regarding Jackpot Functions in the case of Progressive Jackpots, and at a minimum provides information on:

aa. The maximum prizes and/or time limits that may exist for Progressive Jackpot Functions.

bb. The manner in which the Progressive Jackpot is financed and determined.

cc. Whether there is a minimum Participation sum in order for a Player to win a Progressive Jackpot System prize.

dd. The rules that apply to simultaneous wins and payouts, in the event that multiple wins of a Progressive Jackpot Mode occur at approximately the same time, and there is no way of knowing which Jackpot prize was payable first.

5.6 Responsible Gambling, Responsible Gaming

You understand that Novibet applies the Principles of Responsible Gaming, based on a consistent and coherent strategy designed to minimize the negative consequences for Players arising from their Participation in the Games. In this context, you are aware that Novibet:

a. Ensures that the organisation and conduct of the Games is reliable and secure, in accordance with the rules of public order, public interest and the applicable regulatory framework, and also that persons under the age of 21 are excluded from Participation in the Games conducted, vulnerable social groups are protected, and that public health, safety, legality, and the transparency of transactions are not placed at risk.

b. It monitors and stays constantly informed about the developments in relation to the Principles of Responsible Gaming and problematic gaming behaviour, and utilises the findings of recent research in this field.

c. It provides a special section on its Websites containing information about Responsible Gambling (which can be found here: (www.novibet.gr/info/responsible-gambling), ), in which you can find, among other things, information regarding the age from which Participation in the Games is permitted, how Participation decisions should be made, information regarding the Principles of Responsible Gaming, what constitutes problematic gambling behaviour, the harmful consequences and the dangers of excessive exposure to the Games, details of the phone number to call, free of charge, for counselling support services, etc.

d. It has developed a special methodology and tools for the evaluation of the Gaming Activity for all Players who participate in the Games that they conduct, in order to identify and assess the danger of a Player’s normal Gaming Activity developing into problematic gambling behaviour.

e. It discretely and confidentially urges Players to Participate in the Games to an extent commensurate with their financial capacity.

f. It discretely and confidentially urges Players who show signs of problematic gaming behaviour to take regular breaks from the Game (cooling-off period) or to temporarily abstain from Participation in the Games for twenty-four (24) hours, in accordance with the provisions of Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265).

g. It discretely and confidentially urges Players who show signs of problematic gaming behaviour to proceed with temporary or indefinite exclusion, in accordance with the provisions of Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II No 3265).

h. It provides Players, and anyone else who may be interested, with self-evaluation tools (tests) regarding their attitude towards the Games (which can be found here: (www.novibet.gr/info/responsible-gambling)) and encourages them to evaluate their attitude, informing at the same time that:

aa. The test is anonymous and accessible to everyone, and it can be completed by anyone without the need to register (sign up) or log in to the Website.

bb. Anyone interested can take the test at any time and as many times as they wish.

cc. The test is performed in a fully automated manner, and the processing of the answers given by the interested party is essential to production of the results, which are available exclusively to the person conducting the self-assessment, and are not collected, stored, distributed or otherwise processed by the Licence Holder's information systems.

dd. It allows the interested party to save the test results locally on their device, marking the date and time they were produced.

ee. In the event that, for any reason, the test is not completed, the person concerned will have to repeat the process from the beginning.

i. It discretely and confidentially advises Players who demonstrate problematic playing behaviour to seek help by contacting specialised organisations and counselling and/or rehabilitation centres.

j. It blocks Players and closes Electronic Accounts, pursuant to a court ruling or request from their legal defender.

k. It retains the right, on the basis of its duly justified decisions, to temporarily or indefinitely exclude Players, if their gaming activity data, the information in its possession, and the respective Responsible Gaming Policy that it applies, indicates that they are demonstrating problematic gambling behaviour and, despite repeated prompting from Novibet, they have failed to exclude themselves.

By virtue of this Agreement you consent to the evaluation of your Gaming Activity with the object of applying the Principles of Responsible Gambling, and you are aware and understand that the obligations of Novibet in this respect are imposed by existing legislative provisions and are aimed at protecting both you and society as a whole.

5.7 Exclusion of Players 

By virtue of this Agreement, Novibet wishes to inform you that you may apply for temporary abstention, or temporary or indefinite exclusion from participation in the Games, and that:

a. Your application can be submitted through your Online Account.

b. On submission of the respective application for temporary suspension, Novibet will assign "blocked" status to your Electronic Account and use of your account will remain blocked for twenty-four (24) hours.

c. On submission of the respective application for temporary exclusion, Novibet will assign "blocked" status to your Electronic Account and use of your account will remain blocked for a minimum of one month.

d. On submission of the respective application for indefinite future exclusion, Novibet will close your Electronic Account and the contractual relationship shall be terminated. Novibet wishes to inform you that settlement shall be carried out in accordance with paragraph 5.2.4. above. A new electronic player account can be opened at your request, in accordance with the provisions of the Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette, Series II, No 3265) and the Anti-Money Laundering Regulation, given that at least one (1) year has elapsed since the start of the exclusion, and a new agreement shall be concluded. 

e. By accepting the terms of this agreement and in the event of your temporary or permanent exclusion, you are providing your explicit consent for your inclusion in the Register of Excluded Persons kept by Novibet, as well as in the Register of Excluded Persons kept by the Hellenic Gaming Commission.

f. Your inclusion in the HGC Register of Excluded Persons implies your exclusion from participation in games organised by all licence holders.

g. Deposits in your Electronic Account are not permitted until Novibet has cross-referenced the personal details of the account holder against the information held in the HGC Register of Excluded Persons. 

h. Neither Novibet or its affiliates shall send any form of commercial communication to players with temporary suspension status, or who have been temporarily or indefinitely excluded.

i. Novibet wishes to inform you that it retains the right, on the basis of its duly justified decision, to temporarily or indefinitely exclude you, if from the gaming activity data, information in its possession, and the respective Responsible Gaming Policy that it applies, it appears that you are showing problematic gambling behaviour and, despite repeated prompting from Novibet, you have failed to exclude yourself.

j. Novibet urges and encourages you to seek help and support from an addiction treatment centre operating in Greece.

5.8 Money Transfers

You understand and accept that:

a. Payments of sums for Participation and the winnings derived from Participation must be made to and from Novibet, without the mediation of any third party other than Payment Service Providers established and operating lawfully in Greece or in another Member State of the European Union or the European Economic Area.

b. Deposits made in the Online Player Account are interest free.

c. Transfer of funds between Online Accounts is prohibited.

d. By depositing an amount in your Electronic Account, your full knowledge and explicit acceptance that this is done for the sole purpose of your Participation in the Games is presumed.. 

e. Novibet reserves the right to withhold amounts from your Online Account that correspond to any charges and/or commissions, charges and general costs incurred, provided that these have been made known to you in advance and do not conflict with Minister of Finance Decision No 79835 EX 2020/24.7.2020 (Government Gazette Series II, No 3265) and the applicable legislative provisions.

f. Novibet must, at your request, send you a report on the status of your Electronic Account to your registered e-mail or postal address, within one (1) month, and is obliged to include in this report all Participations and financial transactions carried out during the reporting period, as well as sufficient information such that you can compare the data requested with corresponding information that you may keep yourself.

g. Electronic Accounts that are ‘Inactive’ but continue to have a balance in credit are protected by technical and organisational security measures from illegal access thereto or the illegal withdrawal of funds.

h. In the event that your Electronic Account is incorrectly credited with winnings that you are not entitled to, these amounts belong to Novibet and shall be deducted from your Electronic Account, subsequent to correction of the credit amount and your detailed information, without the need for any action on your part. In the event that your Electronic Account balance is insufficient to deduct the sum of money incorrectly credited to it, you shall continue to owe the difference to Novibet, and Novibet reserves the right to withhold, without further notification, any amount mistakenly credited in this way to the Electronic Account, up to the amount of the difference.

i. You may request the withdrawal of any credit balance of your Account, provided that you are able to provide all necessary information that may be requested by Novibet in order for the respective procedures to be implemented, in accordance with the provisions of the Anti-Money Laundering Regulation and the applicable provisions.

j. Novibet is responsible for ensuring the legality and validity of transactions, insofar as it is proportionally responsible and for this purpose, and it must take every possible measure based on common knowledge, experience and understanding, technological and/or operational, organisational, or business in nature, to control both deposits and withdrawals, even after their completion.

k. Novibet reserves the right to refuse and cancel a transaction, even after its completion, if it becomes aware of any evidence that reasonably calls into question its legality and validity, whether or not this information has been acquired by it, or has been brought to the attention of a person with whom they lawfully cooperate for the organisation and conduct of the Games, or has been provided by another legally-appointed responsible body or authority.. 

l. By accepting the Agreement and the terms governing the processing of personal data, You expressly consent to the processing by Novibet of the data concerning your bank account number, in order to process Financial Transactions between You and Novibet, and also to any verification of your identity, which you provide in order to satisfy the purposes of the Agreement.

m. Novibet sets a specific period of time equal to twenty-four (24) hours from submission of the player's withdrawal request, within which it undertakes to issue the respective payment order, in accordance with the Anti-Money Laundering Regulation and the legislative provisions in force.

n. Novibet has the right to provide you with the option of early redemption (cash back) of Bets, with regard to Betting purchases already made, determining, at its own discretion, the value of the cash back offered to you on each occasion.

o. Early redemption (cash out) of a Betting purchase takes place only if you accept early redemption through your Electronic Account. This acceptance cannot be revoked and constitutes your full and unconditional resignation from the original returns on the bet which was prematurely redeemed, regardless of the subsequent outcome of the Betting event. 

p. Novibet does not offer Games that are played in a currency other than the euro.

q. Novibet wishes to inform you that if it is discovered that you have attempted or are attempting to transact or have made transactions through payment accounts to which you are not a beneficiary, it shall cancel the transaction, prohibit your transactions and Participations using these accounts, and the capital sum shall be refunded to the payee account holder and no winnings will be paid.

5.9 Taxation of Players' winnings

You understand that any profits arising from your participation in the Games are taxed, as appropriate, in accordance with the provisions of Law 2691/2001 (Government Gazette Series I No 266) ‘Ratification of Tax Code Provisions pertaining to Inheritances, Donations, Parental Donations, Dowries, and Gambling Winnings’, as in force at any given time. 5.10 Certificate of winnings

You understand and accept that:

a. You have the right to receive, upon request, a certificate of total winnings paid out in the year previous to the application, subject to the terms and procedure set out in the Anti-Money Laundering Regulation and Novibet’s company policy. 

b. The certificate is issued only if your full details are certified and authenticated, in accordance with the Anti-Money Laundering Regulation and existing legislative provisions.

c. Novibet has the right to refuse to issue a certificate of winnings, in accordance with Law 4557/2018 (Government Gazette Series I No 139) and the Anti-Money Laundering Regulation.

The above similarly applies to the issuance of a certificate of winnings in the event of the creation of an Electronic Roaming Account in accordance with the Anti-Money Laundering Regulation.

5.11 Cancellation of Events, Participations and Transactions 

You understand and accept that Novibet pursues a cancellation policy with regard to Events and/or Participations and/or Transactions and, in this context, either as a precaution or ex-post:  

a. It reviews and evaluates any data or information that comes to its attention that may affect the integrity of the organisation or conduct of an event.

b. It is obliged to cancel the offer of events and/or to suspend the settlement of Participations and Transactions related to a cancelled event offered:

aa. When it has sufficient evidence to challenge the integrity of a bet and/or when it has sufficient evidence that, when the bet was placed on the event, Suspicious or Unusual Transactions took place or were or are being attempted as per the Anti-Money Laundering Regulation or the existing legislative provisions, and/or when it has sufficient information to determine collusion between Players, or there is sufficient evidence from which it appears that the integrity of the Games is compromised.

bb. When it has sufficient evidence that the organisation and/or conduct of the offered events took place in violation of existing provisions or the rules of conduct of the Game as foreseen in the Game Guide.

cc. By order of the legally competent authorities.

c. It may cancel the offer of events and/or suspend the settlement of Participations and Transactions related to a cancelled offer, if it is proven that a human or technical error has occurred in the offer of the event or in the acceptance of participations and related transactions (e.g. errors in the details of potential returns, errors in the time Participations were accepted, errors in the debiting or crediting of Electronic Accounts, etc.).

d. It shall implement the cancellation policy and treat the same or similar cases in the same manner, taking the same or equivalent measures in relation to all Players who appear to fall within the scope of this policy.

e. It takes all due care and measures to ensure that the cancellation policy for bets offered and/or suspension of settlement of Participations and Transactions related to the canceled offer, is implemented in a timely manner and anyway within a reasonable period of time after occurrence and awareness of the circumstances prompting the relevant decisions.

f. It has the right to include special cases giving rise to cancellation of Participations due to violation of the rules of a Game or Group of Games in the Game Guide, as well as to apply rules and procedures for redistribution of payouts and winnings, when a cancellation affects the payouts of other Players who are not responsible for the acts prompting the relevant decisions.

Novibet wishes to inform any interested party that it implements a Personal Data Protection Policy in accordance with the General Regulation on the Protection of Personal Data [Regulation (EU) 2016/679] and Law 4624/2019 (Government Gazette Series I No 137) which is posted on its Website [www.novibet.gr/info/privacy-policy].

The processing of personal data is carried out in accordance with the Personal Data Protection Policy and includes, but is not limited to, the purposes of the processing, the categories of data to be processed, the information that Novibet is required to provide to the data subject, the identity and details of the controller or their representative, the time of data storage, the rights of the subjects, the technical and organisational security measures and any other necessary arrangements, information and procedures, which the interested party is required to know. By virtue of this contract we wish to inform you that:

a. In the context of the organisation and conduct of the Games, the legal basis for the processing of your personal data is the conclusion and execution of this Agreement. Your data may be subject to automated processing, including profiling.

b. By accepting the Personal Data Protection Policy you are acknowledging and accepting processing in accordance with the terms indicated therein [www.novibet.gr/info/privacy-policy].  

c. Novibet is obliged to comply with the General Regulation for the Protection of Personal Data [Regulation (EU) 2016/679] and Law 4624/2019 (Government Gazette Series I No 137), to take the appropriate preventive technical and organisational measures so that it is not possible to illegally process the data and identify the Players by technical or other means that can reasonably be used by third parties and to ensure that the company itself, any data processors, as well as those who maintain a relationship with it by employment, project or mandate, do not disclose the identity of persons they know to be participating in the Games or who have made any profit or lost any sum of money as a result of their Participation therein, and do not disclose, for any reason, their personal information and data without the prior written consent of the data subject, unless such consent is not required when the data is made available within the framework of obligations that Novibet, and any person maintaining an relationship with it by employment, project or mandate, are subject to by law.

d. When consent is required, you, as the data subject, have the right to withdraw it at any time. However, withdrawing consent does not affect the legality of the processing based on consent prior to withdrawal. 

e. You, as the data subject, will be informed of any modification or extension of the purposes of processing and the categories of data to be processed, in order to renew your consent, otherwise this Agreement shall automatically be terminated. 

f. You, as the data subject, are obliged to immediately inform Novibet, if the data entered during your registration on the Website, has changed, either by updating the details of your Electronic Account, or by contacting Novibet, in accordance with the provisions of the Anti-Money Laundering Regulation.

g. The HGC, as well as any other competent public body or authority, have access to and are permitted to process the data, when such processing is necessary for the performance of a task performed in the public interest or in the exercise of powers assigned to them as a public authority.

h. You hereby acknowledge and agree that you have been informed about Novibet’s Privacy Policy, otherwise this Agreement may not be concluded.

Limitation Of Liability

Novibet shall not be liable to you and/or third parties for problems, malfunctions, technical failures, failures of your equipment or software, interference or attempts to interfere with the network and its systems and components used in conduct of its activity, which are not the result of gross negligence or intent to defraud on the part of Novibet, its employees or its affiliates, or for loss of profits caused by the interruption and/or cancellation of Events, or for errors in data entry, storage and/or processing of registered data, or for incomplete and inaccurately transmitted data, that is not due to gross negligence or intent to defraud on the part of Novibet, its employees or its affiliates, or for any similar reason even if not explicitly referred to in this Agreement.

Novibet has the obligation to serve you and answer your requests, questions and queries, in a timely and reliable manner. You will be expressly informed by Novibet under any circumstances where conversations with the Novibet Customer Service Department are recorded, as well as in any case where the communication is followed by Your evaluation of the service provided, in an automated or non-automated manner.

Novibet does not charge you when you contact customer service, and you are only charged with the charges of the telecommunications provider you use.

Communication - Notification Of Players

a. Novibet communicates with you and generally keeps you informed through posts and messages in your Electronic Account or through notifications sent to the email address you declared when you created your Electronic Account and, if this address has changed, to the latest email address declared by You.

b. The message/notification is deemed to have been received by you on the date of transmission.

c. You may not use more than one email address at a time, either for Participation purposes or for information/notification purposes.

d. In order for Novibet to legally send you commercial communications material, you must first consent electronically to the sending of such material through a procedure separate to that foreseen for acceptance of this Agreement. Novibet shall set a relevant contractual term pertaining to Your consent to the receipt of commercial communications material for the Affiliates with whom it cooperates.

e. Novibet gives you the opportunity to stop receiving commercial communications material at any time, by withdrawing your consent at the following link [www.novibet.gr/useraccount/settings]. 

f. For the purposes of this Agreement, the above communication of Novibet to You is deemed to constitute written communication.

g. Details of the regulatory framework governing the conduct of the Games is posted on the Novibet and HGC websites (see here: https://www.gamingcommission.gov.gr/index.php/nomiki-vivliothiki ).

Complaints

a. You have the right to submit to Novibet any complaints, grievances, or disputes regarding issues or events related to the Games conducted by Novibet and/or related transactions, and at the following link (www.novibet.gr/info/complaints) you can find the appropriate form, which you can complete and submit to the email address ([email protected]) created by Novibet specifically for this purpose, no later than forty-eight (48) hours from the date following the event.

b. The complaint should include the necessary details of your identity and contact information, and in particular:

aa. Full name and father’s name

bb. Date of birth

cc. Number of currently valid identity card or passport

d. Full address of permanent residence

ee. Address and preferred means of response

and it should be accompanied by a copy of your identity card or passport or equivalent document from which your identity can be ascertained.

c. The complaint should adequately describe the events, time and the reasons you are invoking, and should include any information you may have which in your opinion substantiates your allegations.

d. Novibet shall review the information referred to in the complaint and shall in any event notify you regarding the outcome of its review within ten (10) days of submission thereof.

e. If Novibet’s response does not satisfy you, you may, within ten (10) days from the day after notification thereof, request a review of the complaint from the Hellenic Gaming Commission. The application for review by the Hellenic Gaming Commission must be notified by you to Novibet, which will duly forward, without delay, a response and any information related to the complaint to the HGC.

f. Novibet reserves the right not to respond to complaints which have become abusive due to inordinate repetition.

g. Novibet will not reveal to you data or information for which it has an obligation of confidentiality and/or non-disclosure in accordance with legal provisions currently in force.

Resolution Of Disputes

a. Any disputes arising from this Contract shall be subject to the exclusive jurisdiction of the courts of Athens.

b. In the event of dispute, disagreement or doubt arising out of or in connection with this Agreement, Novibet and Yourself must make every effort to settle the dispute amicably, in accordance with the provisions of this Agreement, having previously notified the HGC of the details and data relating to the dispute and announcing our intention to pursue amicable settlement.

c. In the event of failure to reach amicable settlement of the dispute in accordance with the above, the contracting parties to this Agreement, namely Novibet and Yourself, may apply to one of the Alternative Dispute Resolution Bodies (ADRs) listed in the respective Register kept in accordance with the provisions of Joint Ministerial Decision Ref. No 70330 oik./2015 (Government Gazette Series II, No 1421), as valid at any given time, having notified the Hellenic Gaming Commission of the evidence and facts relating to the dispute, and indicating our intention to settle.

d. The HGC may prohibit the parties from settling a dispute amicably or seeking recourse to Alternative Dispute Resolution Bodies (ADRs), if the evidence in the case shows that the outcome sought by settlement or resolution is contrary to or circumvents the existing provisions and conditions of this Agreement.

e. The settlement or resolution reached does not invalidate the right of the parties to appeal to the competent courts to protect their rights, unless they have waived such right.

f. The settlement reached between the parties does not negate the right of the HGC to carry out the inspections required by law and to impose the administrative sanctions provided for by the applicable legislative provisions.

Force Of Evidence

a. The Contracting Parties agree and accept that orders, data and transactions transmitted electronically via the Internet are automatically recorded in a file and have the force of absolute proof as to their time of registration and their content. Furthermore, it is agreed that the storage of details of your Participation in the Central Information System of Novibet constitutes fully complete evidence for all the data and information pertaining to the Gaming Activity.

b. The data registered in the Novibet Central Information System, as well as the books and records, which are issued and kept for accounting or supervisory purposes in printed or electronic form, including copies and excerpts thereof, have full probative value in respect of the records contained therein.

c. In the event of an incorrect money transfer order to or from your Electronic Account, you expressly waive the right to request the cancellation of the order and the legal act drawn up in accordance with it.

Assignment

You understand that you are expressly prohibited from assigning or transferring any rights and/or obligations arising from this Agreement to any third party, natural or legal person.

 

15

Valid Term - Termination Of The Contract

a. This Agreement lasts for as long as Novibet legally provides its services under the Licence(s) and you continue to make lawful use of those services in accordance with the terms of this Agreement and the applicable provisions.

b. This Agreement may be terminated without notice by the contracting parties at any time.

c. Termination of this Agreement takes place either by submission of an application to close your Electronic Account, a sample of which is posted on the Novibet Website at the following link www.novibet.gr/useraccount/settings) which you can complete and submit electronically to the e-mail address ([email protected]), or by closure of your Electronic Account by Novibet, in accordance with the terms of this Agreement and the applicable legislative provisions.

d. The other contracting party must be duly notified and this entails, as of the date of notification, the termination of this Agreement and the closure and settlement of your Electronic Account, in accordance with the provisions of the law.

The following terms of this Agreement shall remain in force even after its termination or dissolution in any way: 5, 6, 7, 11, 12, 14.

Other Terms

a. The terms of this Agreement, as well as the corporate policies and texts to which they refer, constitute Novibet 's full agreement with you on the matters governed by this Agreement and the policies in question.

b. With regard to any matter not regulated by this Agreement, the legislative provisions currently in force are applicable and shall prevail over any term of this Agreement which is contrary to them.

c. In the event that any term of this Agreement is deemed null or void, the validity of the remaining terms shall remain unaffected.

d. Novibet retains the right, subject to the respective approval of the HGC to adjust any term, which may be deemed null or void, in order to eliminate the reason for its invalidity while preserving, in so far as is possible, the content thereof.

e. This Agreement is governed by Greek Law. Any dispute or tort that arises in the context of the Contract or on its occasion, including any court hearing during enforcement or any interim measures, shall be subject to the exclusive jurisdiction of the Courts of Athens.
